Data Privacy Policy

METOS® CANADA Inc. (“METOS®”) operating as METOS® Canada knows that protecting your data is important to you. It’s also important to us. This Data Privacy Policy attempts to use plain language to outline how your data is collected, stored and protected as well as to clearly outline what METOS® may do with the data generated by any equipment or software products you have acquired or subscribed to from METOS®.

Your data is yours and you can do whatever you choose with your data generated by either a purchase or subscription of equipment or software products from METOS®. METOS® and its affiliates and related parties and their database management providers require your consent to collect, store and use the data captured to fulfill the obligations created by any agreement between you and METOS®.

METOS® shall be entitled to render the data captured or generated by the equipment and/or software products anonymous, meaning that METOS® and its affiliates shall be free to use such non-personal or generic data in any manner. The data shall be rendered non-personal or generic as a result of combining and/or aggregating data collected from the other equipment or software products in a way that no longer personally identifies the user. METOS® will never purposefully disclose your personal information, or any data specific to you except as outlined in this Data Privacy Policy.

Principles:

1. Data Collected by the Equipment and Software

The equipment and software supplied by or through METOS® collects data from various probes, sensors or weather stations. This data can potentially include, but is not limited to, soil temperature, saturation levels and nutrient content from probes or sensors and temperature, relative humidity, wind speeds, rainfall, and barometric pressure, among other things, could be captured from weather stations. You may access this data via the Field Climate Application licensed from Pessl Instruments, or via a direct link with another software supplier.

2. Ownership of Data

METOS® confirms that the data collected from, and analyzed for you is your data, and you own the data and have the right to share, download and delete such data at your discretion. METOS® and its affiliates can access the data collected and has the right to use such data in an aggregated or combined manner that will render it non-personal or generic in accordance with this Data Privacy Policy.

3. Third Party Service Providers

Any third-party service providers engaged by METOS® to assist with the collection and analysis relating to the equipment and software supplied by or through METOS® shall receive such data solely for their service and shall not use your data for any purpose other than the collection and analysis of your data.

4. Consent to Use Your Data

We will not provide any third parties with access to any personal data without your prior written consent, except in two circumstances:

(a) On a confidential basis to our employees, service providers, consultants, representatives and agents who would need to have access to your data for the provision of METOS® services; and

(b) If disclosure was compelled by an applicable court, legislative or administrative body, under Federal or Provincial law.

5. Availability and Retention of Data

All data collected and analyzed by METOS® for you shall be accessible by you. METOS® shall retain the data for the term of the agreement with you and for at least 30 days thereafter. Such data may be converted into a different digital format than the data was originally submitted. You may request the complete data file at any time during the term of the agreement with METOS® and for a period of up to 30 days following the termination or expiry of such agreement.

6. Notification of Changes

METOS® will notify you of any changes to the use and treatment of your data from the terms contemplated herein.

7. Notification of Breach of Data

METOS® shall notify you if any of your personal or non-generic data is inadvertently disclosed to a third party. METOS® takes great care to ensure your data is secure but also recognizes there is a risk of a data breach due to a cyber-attack.

8. Deletion of Your Data

METOS® will process any request by you to delete data collected or analyzed from the equipment and software supplied by or through METOS® at your location, which deletions shall be completed within 30 days of receiving the request from you. For greater certainty, data collected from you that has been aggregated or combined in a manner that will render it non-personal or generic will be retained by METOS® for future use in any manner whatsoever. 9. Treatment of Data Upon Sale of METOS®

In the event of a sale or reorganization of METOS®, any purchaser or successor to METOS® shall have the same rights and obligations to you and your data as METOS® has as of the date of such sale or reorganization.
